The Law Should Matter, Even To The President.
No One Should Be Above The Law, Especially Not The President.
Republicans have long branded themselves the party of “law and order.” Lambasting Democrats for being “unconstitutional” or “supporting criminals.”
The problem with this seems to arise when its things Republicans want that don’t follow those pesky little laws. Then all of a sudden we need to reevaluate their legitimacy.
Or when their nominee is found guilty of 34 felony counts, or when he needs to ask the Supreme Court for immunity from the law when conducting official acts.
Pretty much, the Republican mantra is “law and order for thee, but not for me.”
But laws are important aren’t they?
They are especially important for those in power, who otherwise could act with impunity. They act as a sort of guardrail from corruption or wrongdoing from those who can’t be prevented by just social stigma or financial implications.
Which is uniquely true for the President. If not losing power, or going to prison, what is there to stop him from engaging in corrupt or illegal actions? Especially in Trump’s case where he is not worried about reelection.
The answer is simple: there is none.
This is what we are seeing play out in real time, as Trump knows he can’t go to prison for any of his actions, thanks to his immunity from the Supreme Court. He also knows in a Republican-majority House and Senate that he will not be impeached.
It empowers him to attempt things like ending birthright citizenship, something protected under the constitution. As he will not be impeached for unconstitutional actions, at worst a judge will block it.
Or when blocked from freezing federal grants and loans, something directly against the Impoundment Control Act, his officials can just refuse to comply.
It’s almost like Trump is trying to set a record of illegal actions he can get blocked, probably in hopes a few slip through.
Going against the Administrative Procedure Act, Trump attempted to put USAID workers on leave. A way to effectively render the agency useless without congressional approval. Fortunately a judge has already blocked this as well.
This was matched with a sweeping buyout offer of federal employee’s, of whom Project 2025 details will be replaced with loyalists, but this was also swiftly blocked by a federal judge. As it would hinder the governments ability to operate and have its programs function, again overstepping the reach of the executive without congressional approval.
In another violation of the Administrative Procedure Act, Trump tried to block funding for medical research through the NIH. This was obviously shot down by a judge after a lawsuit brought by multiple states.
These losses in federal court led to JD Vance then posting publicly that the Judges were acting outside of the scope of their power, seemingly signaling the Administration will ignore their rulings.
This is obviously unconstitutional, article 3 of the constitution establishes the Judicial branch of the government. It establishes its ability to review actions by the executive and legislative branches.
Marbury v Madison all the way back in 1803 was a Supreme Court case that also established the precedence that the judicial branch does indeed have the ability to determine the constitutionality of the actions committed by the other two branches.
The party who considers themselves true American Patriots who value the constitution are now the party who either don’t know this fundamental principle of America, or do not value its worth.
